Terms of Service

Effective date: April 24, 2026. Last updated: April 24, 2026.

In short

These Terms cover the Spell State web app, our public websites (including spellstate.com), and any native mobile app we release later that uses the same service. Play fair, do not abuse the systems, and use Fan Content responsibly. The service is provided as-is.

Spell State is operated by Future Design 3D ("we," "us," "our"). By accessing or using any part of the Services (defined below), you agree to these Terms of Service and our Privacy Policy. If you do not agree, do not use the Services.

Section 1

The Services

The Services include all of the following that we make available now or in the future:

We may add, change, or retire parts of the Services. When we release a mobile app, store rules from Apple, Google, or others may also apply to your installation and use of that app in addition to these Terms.

Section 2

Eligibility and accounts

You may use session features without an account where the product allows it. If you create an account, you must provide accurate information, keep credentials secure, and not share your login with others in a way that lets them impersonate you. One person should not maintain multiple accounts to evade limits, bans, or fair use.

The same account may sign in from the web app, marketing flows, or a future mobile app unless we say otherwise. You are responsible for all activity on your account.

If you are under 13, do not create an account. If you are 13 or older but under 18 (or the age of majority where you live), you should use the Services only with a parent or guardian who accepts these Terms on your behalf where required by law.

Section 3

Acceptable use

You agree to use the Services only for lawful purposes. You agree not to:

We may investigate misuse and suspend or terminate access when we reasonably believe a violation occurred.

Section 4

Magic: The Gathering and third-party content

Spell State is an independent tool for tracking tabletop play. It is not produced or endorsed by Wizards of the Coast.

Fan Content

Spell State is unofficial Fan Content permitted under the Wizards of the Coast Fan Content Policy. Not approved or endorsed by Wizards of the Coast. Portions of materials used are property of Wizards of the Coast. Copyright Wizards of the Coast LLC.

Magic: The Gathering is a trademark of Wizards of the Coast LLC. Card data, names, or images may come from third parties such as Scryfall; those materials remain subject to their own terms and notices.

Section 5

Your content and game data

You retain rights to content you type into the Services (for example display names or session notes), but you give us a non-exclusive license to host, process, transmit, and display that content only as needed to run the Services for you and other players in the same session.

Game sessions and related data may be temporary. We do not promise indefinite storage of session state. We may delete or archive inactive sessions, reset sandboxes, or change retention for operational or legal reasons. See the Privacy Policy for how long we keep categories of data.

For competitive or high-stakes play, verify critical game state on the table, not only on screens.

Section 6

Fees

The Services are currently offered without a mandatory fee. We may introduce optional or paid features in the future. If we do, we will describe pricing and billing terms at the point of purchase or in an updated version of these Terms.

Section 7

Changes to the Services and to these Terms

We may modify features, infrastructure, or these Terms. We will update the effective date at the top of this page when we make material changes. For serious changes, we may also use email (if we have it) or in-product notices. Continued use of the Services after changes become effective means you accept the updated Terms. If you do not agree, stop using the Services and delete your account where available.

Section 8

Disclaimer of warranties

The Services are provided "as is" and "as available," without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent allowed by law.

We do not warrant uninterrupted or error-free operation, that defects will be fixed on any schedule, or that the Services will meet your requirements.

Section 9

Limitation of liability

To the maximum extent permitted by law, Future Design 3D and its operators, contractors, and suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, goodwill, or game outcomes, arising from or related to your use of the Services.

To the extent we are liable for direct damages, our total liability for any claim arising out of or relating to the Services is limited to the greater of (a) fifty US dollars (USD $50) or (b) the amount you paid us specifically for the Services in the twelve (12) months before the event giving rise to the claim. If you paid nothing, the cap is USD $50.

Some jurisdictions do not allow certain limitations. In those places, our liability is limited to the minimum allowed by law.

Section 10

Indemnity

You agree to defend and indemnify Future Design 3D and Spell State against claims, damages, losses, and expenses (including reasonable attorneys' fees) arising from your use of the Services, your content, or your breach of these Terms, except to the extent caused by our intentional misconduct.

Section 11

Suspension and termination

We may suspend or terminate your access to any part of the Services at any time if we reasonably believe you violated these Terms, created risk or legal exposure for us, or need to do so for security or legal reasons.

You may stop using the Services at any time. To request deletion of a registered account and associated personal data, contact [email protected] unless we provide a self-service delete tool in the product. After deletion, some information may remain in backups for a limited period as described in our Privacy Policy.

Section 12

Governing law and disputes

These Terms are governed by the laws of the United States, without regard to conflict-of-law rules that would apply another country's laws. If you are a consumer, mandatory protections in your country of residence may still apply where the law requires and cannot be waived.

Except where prohibited by law, you agree that exclusive jurisdiction and venue for disputes arising from these Terms or the Services will lie in the courts located in the United States; we both consent to personal jurisdiction there.

Section 13

General

These Terms together with the Privacy Policy are the entire agreement between you and us about the Services. If one part is unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, sale, or reorganization.

Section 14

Acknowledgment

By using the Services, you confirm that you have read these Terms of Service and our Privacy Policy and that you agree to be bound by them.
